A Saratoga Springs man is facing assault, drug, and drunk driving charges after police have concluded their investigation into an accident that occurred in Clifton Park, New York this past summer.

On August 22, 2013 25-year old Daniel Stack was involved in a two-car accident at 12:13pm west of Nott Road on State Route 146.  In a written release authorities say the driver of the other car “suffered serious physical injuries as a result of the accident.”

During the initial rescue and investigation by emergency response teams Route 146 was closed in Clifton Park between Nott Road and Blue Barns Road for more than four hours.  At the time police issued a release stating that “charges are expected to be filed upon the conclusion of the investigation.”

New York State Police now say that Stack had a blood alcohol concentration of 0.10-percent as well as marijuana in his blood while driving.  He was headed westbound in his 2009 Honda Civic when he allegedly crossed over the double solid line, hitting a 2007 Camry head-on.

The driver of the Camry was identified as 63-year old Ertugrul Berkcan from Clifton Park. Both Stack and Berkcan had to be extricated from their cars and flown by LifeNet Helicopter to Albany Medical Center.

In addition to troopers, the Rexford, Jonesville, Vischer Ferry, and Niskayuna Fire Departments, along with Clifton Park Halfmoon Ambulance, were involved at the scene of the August accident.

Stack was arrested on December 6th for felonious vehicular assault, drunk and impaired driving, and drug possession.  He was released and is scheduled to appear in the Town of Clifton Park Court on December 11, 2013.
